Convoy Terms and Conditions

These terms and conditions apply to Personal Training, Small Group Training, Coaching and Open Gym services at Convoy Gym in IJburg.

Article 1: Definitions

  • The Organization: Convoy.
  • KVK Number: 76376923, registered under the name Convoy V.O.F.
  • Agreement: The contract between Convoy and the Participant based on these terms and conditions.
  • Subscription: Also refers to the Agreement between Convoy and the Participant.
  • Participant: The natural person entering into an Agreement with Convoy.
  • Personal Trainer: The natural person providing training services on behalf of Convoy.
  • Training: The personal or group training session conducted by Convoy.
  • Group Class: A fitness class involving multiple participants led by an instructor.
  • Personal Training Session: A one-on-one training session with a Personal Trainer.

Article 2: Applicability

These terms and conditions apply when the Participant registers, directly or indirectly, for Personal Training, fitness classes and/or Open Gym at Convoy. An Agreement is established following the Participant’s written registration with the Organization.

Deviations from these terms are only valid if explicitly agreed upon in writing. Convoy reserves the right to modify these terms and conditions and will communicate such changes in advance.

Article 3: Intake Procedure

To ensure responsible participation in sports, the Participant must undergo an intake interview prior to engaging in activities. The intake form must be completed truthfully and signed. Based on the intake and interview, Convoy may deny participation.

Article 4: Offers

All offers and quotations are non-binding unless stated otherwise. Offers do not automatically apply to future Agreements. Convoy is not bound by obvious errors or mistakes in publications, agreements, quotations or other correspondence.

Article 5: Billing

  • Subscriptions must be paid in advance via bank transfer or direct debit.
  • Late or incomplete payment may lead to denied access, suspension or termination of the Agreement.
  • Direct debit and bank payment prices are based on a subscription agreement of at least 3 months.
  • If registration starts during an ongoing month, the remaining amount will be charged pro rata.
  • Services are subject to VAT rates of 21% and 9%.
  • Convoy reserves the right to apply interim price increases in unforeseen circumstances.
  • Invoices are sent by email unless a paper invoice is explicitly requested.

Article 6: Subscriptions

The initial subscription has a specific duration. After expiry, unless cancelled, it converts into a subscription for an indefinite duration unless otherwise agreed. Membership rights are strictly personal and non-transferable.

Article 7: Temporary Suspension of Subscription

To terminate a subscription after a specified period, written notice must be given by email at least one calendar month in advance. Early termination is not permitted, except in limited approved medical situations supported by a statement from a recognized doctor or therapist.

Article 8: Appointments, Access Pass and Credits

  • Appointments cancelled less than 24 hours in advance will be charged.
  • Convoy may cancel a training session with at least 2 hours’ notice.
  • Participants receive a digital access pass only with a valid membership.
  • Personal training membership credits must be used within the same calendar week unless part of a separate package.
  • Class memberships with 4 or 8 credits per 4 weeks cannot carry unused credits into the next 4-week block.

Article 9: Opening Hours

Convoy may modify the class schedule when needed. Classes may be cancelled on public holidays. Open Gym with a personal access key is available daily from 07:00 to 22:00.

Article 10: Training Program

Convoy aims to provide high-quality guidance through qualified trainers. Results are never guaranteed, as progress also depends on the Participant’s own consistency and commitment. Participants must report relevant pain, discomfort, fatigue or health changes.

Article 11 & 12: Conduct and Dress Code

Participants and visitors must follow Convoy’s rules regarding attire, order and discipline. Appropriate sports clothing and sports shoes are required during training sessions.

Article 13 & 14: Liability and Force Majeure

Participation in training is at the Participant’s own risk. Convoy is not liable for injury, theft, loss or damages except where required by law and within the limits described in these terms. In cases of force majeure, including illness, internet disruption, weather conditions or government measures, Convoy may be unable to fulfill obligations temporarily.

Article 15: Termination

Convoy may terminate the Agreement immediately in the event of rule violations, harmful behaviour, or prohibited substance use. Early termination by the Participant is only possible for medical reasons supported by a recognized medical certificate. Membership fees are non-refundable.

Article 16: Privacy

Convoy handles personal data with care and in accordance with GDPR. Personal data is used for administrative purposes and not shared with third parties unless legally required. Invoice data must be retained in accordance with legal obligations.

Article 17: Intellectual Property

Training plans, methodologies, models, booklets and tools developed by Convoy remain the property of Convoy. Audio or video recordings of training sessions and trainers are not allowed without prior written permission.

Article 18 & 19: Disputes and Miscellaneous

Complaints may be directed to Convoy. All agreements are governed exclusively by Dutch law. Convoy reserves the right to adjust rates and these terms and conditions with at least one month’s notice where applicable.

Article 20: Camera Surveillance

Cameras are installed in public areas only for safety, security and property protection. Footage is stored securely for a maximum of 4 weeks unless required longer for a specific incident.

Article 21 to 26: Restricted Areas, Access Keys and Safety

  • Staff-only areas may not be entered by members.
  • Members must close doors and windows properly when leaving.
  • Failure to secure the building may lead to a €200 fine.
  • Sharing personal access keys is strictly prohibited and may also lead to a €200 fine.
  • If training alone, keep the front door closed for safety.

Article 27: Training at Your Own Risk

All training is at the Participant’s own risk. Participants must disclose relevant injuries or medical conditions, follow safety instructions, and use appropriate precautions when training alone or performing heavy lifts.

Article 28: Use of Images and Videos

Convoy may take photographs and record videos during sessions and events for promotional purposes, including social media, website and marketing materials. Participants may withdraw consent by written request.
